📄 Abstract
This article appraises the Nigerian Climate Change Act 2021 which is the first climate change legislation in Nigeria. The article also examines the human rights approach to climate change in view of the growing correlation between climate change and human rights globally. Climate change is the greatest environmental threat to lives and properties worldwide. As a result, human rights actions remain the greatest tools through which climate justice can be promoted. The decision of the Pakistan court in Leghari v. Federation of Pakistan, for instance, stands out as a precedent for human rights action based on state failure to enforce Climate Change Act. It is obligatory on the government to enforce the provisions of this Act. To this end, the article appraises this decision in relation to the Climate Change Act, 2021, and enjoins courts in Nigeria to borrow a leaf from the Pakistan courts in the determination of rights-based climate actions in Nigeria.
