📄 Abstract
The classical liberal ideal of the "marketplace of ideas," first articulated by John Stuart Mill and later enshrined in American First Amendment jurisprudence, relies on an unstated axiom of epistemic symmetry: the assumption that truth and falsehood require roughly equivalent cognitive and material labor to produce, distribute, and evaluate. In this paper, we argue that digital hyper-abundance has collapsed this marketplace by revealing and actively exploiting a fundamental structural flaw defined by Brandolini’s Law (the "bullshit asymmetry principle"). This essay formalizes the energetic calculus of modern disinformation, drawing on Harry G. Frankfurt’s ontological distinction between traditional lying and "bullshit," and dual-process cognitive psychology. It shows that in an engagement-driven algorithmic environment, the frictionless production of bullshit systematically bankrupts the rigorous, high-cost labor of truth-seeking. Authoritarian "flooding the zone" tactics are thus epistemic sabotage, achieving censorship not by state suppression but by the cognitive exhaustion of the democratic public. Ultimately, this paper concludes that the traditional liberal remedy of "more speech" structurally guarantees the defeat of the truth-teller, necessitating a philosophical and legal paradigm shift—from content-based speech assessment toward structural interventions targeting the velocity, volume, and algorithmic amplification of information.
